Chen Leong Doo.
We are instructed by the Defendants in the
two above cases which are to come on for hearing at the
Bridlington Police Court on Saturday the 3rd proximo.
Man You is charged for that being an alien he has failed to
register in accordance with the provisions of the Aliens Order
of 1920 and Chen Leong Doo is charged with having harboured
Man You, an unregistered alien.
The Defence to the charges is
that Man You is not an alien at all, but a natural born British
subject, he having been born in Hong Kong 32 years ago. Under
the Aliens Act, however, the onus of proving alienage or other-
wise is thrown on to the alleged alien and therefore in this
case the onus is on us and the only evidence we have is Man
You's sworn statement as to the place of his birth backed up
by the fact that he made this statement before any charge was
made against him.
